Overview
The Insolvency and Bankruptcy Code, 2016 has fundamentally reordered the legal landscape for creditors and debtors in India. It introduced time-bound resolution processes, a sophisticated waterfall mechanism for distribution of proceeds, and a professionalised framework for insolvency resolution — substantially altering how financial distress is managed across Indian businesses.
