Briefing an Advocate-on-Record
at the Supreme Court.

This page is for advocates practising before High Courts, District Courts, and specialised tribunals who need to file and appear in Supreme Court proceedings on behalf of their clients.

The Advocate-on-Record Designation

The Supreme Court of India operates under a distinct procedural framework governed by the Supreme Court Rules, 2013. Under Order IV Rule 1, only an Advocate-on-Record may file vakalatnamas, lodge plaints or petitions, and act on behalf of parties in all Supreme Court proceedings. No other advocate — regardless of seniority, designation, or experience — has this right.

An Advocate-on-Record must pass a specialised examination administered by the Supreme Court and complete a period of training. The designation is personal and non-transferable. When you brief an AOR, you are engaging the specific individual who holds that designation, not a firm that happens to employ one.

What Briefing Counsel Retains

The AOR arrangement does not displace briefing counsel. Advocates who brief Corpus Lawyers as AOR retain complete conduct of the matter. The AOR files, signs, and appears as required by the Rules. Briefing counsel continues to advise the client, develops legal strategy, prepares arguments, and briefs the AOR on all case developments.

All client communications on the substance of the matter continue through briefing counsel. The firm provides regular updates on filing status, hearing dates, and any procedural developments at the Supreme Court.

How to Brief the Firm

The firm will confirm availability and respond with a brief indicating the procedural steps, the documents required for filing, and the fees applicable. The AOR arrangement is governed by a separate engagement letter setting out the scope of the AOR’s mandate, the obligations of briefing counsel, and the fee structure.

Documents required for initial briefing typically include: the impugned judgment or order, a brief note on facts and legal issues, prior proceedings in the matter, and any relevant documents that were part of the record below.
